By accessing or using the Writiqx platform and services (the “Service”), you confirm that you have read, understood, and agree to be bound by these Terms & Conditions (“Terms”) and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and Writiqx. If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

Writiqx is an AI-powered content creation platform that enables users to generate blog posts, marketing copy, social captions, SEO content, email drafts, and other written materials using artificial intelligence models. The Service may also include tools for brand voice management, content history, SEO research, image-to-content generation, and subscription management.

The Service is intended for marketing, content creation, and business writing assistance only. It does not provide professional legal, financial, medical, psychological, or other licensed professional advice.

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. The Service is not directed at minors. If you are using the Service on behalf of a business, you represent that you are authorised to enter into contracts on behalf of that business.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@writiq.ai if you suspect any unauthorised access to or use of your account.

You must not share your account with others or allow others to access the Service through your account. Writiqx is not liable for any loss or damage arising from your failure to keep your credentials secure.

Access to certain features of the Service requires a paid subscription. Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on the plan selected). All payments are processed by Stripe, and by subscribing you agree to Stripe’s terms of service.

Subscription prices are displayed at checkout and may be subject to applicable taxes. Writiqx reserves the right to change subscription pricing with reasonable notice. Continued use of the Service after a price change constitutes your acceptance of the new pricing.

Usage credits or generation limits, where applicable, are subject to the terms of your selected plan. Unused credits do not roll over to the next billing period unless explicitly stated.

Writiqx may offer free trials or promotional access at its sole discretion. Free trial eligibility, duration, and available features are determined by Writiqx and are subject to change without notice. At the end of a free trial, your account may be automatically converted to a paid subscription unless you cancel before the trial ends. Writiqx reserves the right to limit free trial access, revoke promotional credits, or discontinue any promotion at any time.

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period; you will retain access to the Service until that date.

Unless required by applicable consumer law, subscription fees are non-refundable. Writiqx does not provide partial refunds for unused time within a billing period. If you believe you are entitled to a refund under applicable law, contact us at support@writiq.ai.

This section is important. Please read it carefully.

The Service uses artificial intelligence models to generate content based on your inputs. AI-generated content:

• May be inaccurate, incomplete, misleading, factually incorrect, or unsuitable for your intended purpose
• May contain outdated information, hallucinations, or fabricated facts
• Is not reviewed, verified, or endorsed by Writiqx before delivery
• Does not constitute professional, legal, medical, financial, or expert advice of any kind
• May not be unique or free from similarity to content generated for other users

You are solely responsible for reviewing, editing, fact-checking, verifying, and legally clearing all generated content before publishing, distributing, or using it in any way. Writiqx expressly disclaims all liability for any consequences arising from your use of AI-generated content without adequate review.

Writiqx makes no guarantee, warranty, or representation — express or implied — that use of the Service will result in any particular outcome, including but not limited to:

• Improved search engine rankings or organic traffic
• Increased conversions, leads, or sales
• Approval of content by advertising platforms (Google Ads, Meta, etc.)
• Compliance with platform terms of service
• Business growth, revenue, or profitability
• Audience engagement or social media performance

Any examples of results mentioned in our marketing materials are illustrative only and do not guarantee similar outcomes.

SEO tools, keyword suggestions, content briefs, and related features within the Service are provided for informational and assistance purposes only. Writiqx does not:

• Provide professional SEO consulting or advice
• Guarantee any improvement in search engine rankings, impressions, or traffic
• Guarantee indexation of any content by search engines
• Represent that its SEO recommendations comply with the current guidelines of any search engine

Search engine algorithms change frequently. SEO results depend on many factors outside of Writiqx’s control, including your website’s technical configuration, domain authority, competition, and search engine decisions.

As a condition of using the Service, you agree to:

• Use the Service only for lawful purposes and in compliance with these Terms
• Review all AI-generated content before publishing or distributing it
• Ensure that your use of generated content complies with applicable advertising laws, intellectual property laws, platform policies, and industry regulations
• Not submit inputs that are illegal, infringing, defamatory, or that violate the rights of others
• Maintain the security of your account and not share access with unauthorised persons
• Promptly report any unauthorised use of your account

You retain all rights to the text, images, brand information, and other materials you submit to the Service (“User Content”).

By submitting User Content, you represent and warrant that:

• You own or have the necessary rights, licences, and permissions to submit and process the content
• Your content does not infringe any third-party intellectual property, privacy, or other legal rights
• Your content does not include confidential information belonging to third parties that you are not authorised to disclose
• Uploaded images are not protected by copyright, privacy rights, or other restrictions that would prohibit their use through the Service

You are solely responsible for the legality, accuracy, and appropriateness of all User Content you submit. Writiqx is not liable for any claims arising from your User Content.

Subject to these Terms and applicable law, you retain ownership of the inputs you provide and the outputs generated for you through the Service. Writiqx does not claim ownership of your prompts or generated content.

You acknowledge that AI-generated outputs may not be protected by copyright in all jurisdictions, and that ownership of AI-generated content is subject to evolving legal frameworks that vary by country. You are responsible for understanding the intellectual property laws applicable in your jurisdiction before relying on any ownership claims.

By submitting User Content to the Service, you grant Writiqx a limited, non-exclusive, worldwide, royalty-free licence to process, store, transmit, and use your inputs, uploaded images, and generated outputs solely to:

• Provide and deliver the Service to you
• Maintain, improve, and debug the Service
• Comply with legal obligations

This licence does not extend to selling your content, using it for advertising without your consent, or sharing it with third parties except as required to provide the Service (e.g., transmission to AI model providers).

You agree to use the Service only for its intended purpose: generating lawful marketing, business, and creative content. You agree not to misuse the Service in any way that could harm Writiqx, other users, or third parties.

You must not use the Service to:

• Generate content that is illegal, defamatory, threatening, harassing, fraudulent, or deceptive
• Create spam, phishing materials, or unsolicited bulk communications
• Generate content that infringes the intellectual property rights of any third party
• Produce content that promotes violence, discrimination, or unlawful activity
• Circumvent, disable, or reverse-engineer any security feature of the Service
• Scrape, crawl, or extract data from the Service using automated means without Writiqx’s express written permission
• Use the Service to train, fine-tune, or develop competing AI models
• Resell or sublicense access to the Service without prior written consent from Writiqx
• Violate any applicable law or regulation

Writiqx reserves the right to determine what constitutes prohibited use at its sole discretion.

All software, design, branding, trademarks, trade names, and other materials comprising the Writiqx platform (excluding User Content) are owned by or licenced to Writiqx and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use Writiqx’s intellectual property without express written permission.

The Service integrates with third-party services including Stripe (billing), Supabase (database and authentication), Vercel (hosting), and AI model providers. Your use of these third-party services is subject to their respective terms and privacy policies. Writiqx is not responsible for the availability, accuracy, or practices of any third-party service, and any disputes with third-party providers must be resolved directly with those providers.

Writiqx will use commercially reasonable efforts to make the Service available; however, the Service is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, system failures, or events beyond our control. Writiqx is not liable for any loss or damage resulting from Service unavailability or downtime.

Writiqx reserves the right to modify, update, suspend, or discontinue any feature or aspect of the Service at any time, with or without notice. We may add, remove, or alter features as part of ongoing development. We will make reasonable efforts to notify users of material changes that significantly affect their use of the Service.

Writiqx may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason including but not limited to:

• Breach of these Terms or any other applicable policy
• Suspected fraudulent, abusive, or illegal use of the Service
• Failure to pay subscription fees
• Legal or regulatory requirements

Upon termination, your right to access the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will continue to apply.

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available” without any warranty of any kind, whether express, implied, or statutory.

Writiqx expressly disclaims all warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and reliability. Writiqx does not warrant that:

• The Service will meet your requirements or expectations
• The Service will be uninterrupted, timely, secure, or error-free
• AI-generated content will be accurate, complete, legal, or fit for any particular use
• Defects or errors in the Service will be corrected

Some jurisdictions do not allow the exclusion of implied warranties. To the extent that applicable law does not permit such exclusion, those warranties apply to the minimum extent required by law.

To the maximum extent permitted by applicable law, Writiqx and its directors, employees, agents, partners, and licensors shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, business opportunities, or goodwill
• Business interruption or loss of anticipated savings
• Damages arising from your use of or inability to use the Service
• Damages arising from AI-generated content you used without adequate review or verification
• Any failure or delay caused by circumstances beyond our reasonable control

In any event, Writiqx’s total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of: (a) the total amount paid by you to Writiqx in the three (3) months immediately preceding the event giving rise to the claim, or (b) AUD $100.

Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent applicable law prohibits such limitations, those limitations shall apply to the minimum extent permitted.

You agree to indemnify, defend, and hold harmless Writiqx and its directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of or access to the Service
• Your User Content, including uploaded images and prompts
• Your use of AI-generated outputs without adequate review or legal clearance
• Your breach of these Terms or any applicable law or regulation
• Any claim that your content infringes the rights of a third party
• Your violation of any third-party rights

These Terms are governed by the laws applicable in the jurisdiction where Writiqx operates, unless otherwise required by applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction, unless you are entitled under applicable consumer law to bring a claim in a different jurisdiction.

Nothing in this clause limits any rights you may have under mandatory consumer protection laws that apply in your jurisdiction.

Writiqx reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and revising the “Last updated” date. Your continued use of the Service after updated Terms are posted constitutes your acceptance of the revised Terms. If you do not agree to the changes, you should stop using the Service and cancel your subscription.
